Article 1. Purpose

These terms of sale aim to define the contractual relations between Cozy Luminaire and the buyer, as well as the conditions applicable to any purchase made through the website https://cozyluminaire.com. The purchase of a product through this site implies unconditional acceptance by the buyer of these terms of sale, which the buyer acknowledges having read prior to placing an order. Before any transaction, the buyer declares that the purchase of products on the site https://cozyluminaire.com/ is not directly related to their professional activity and is limited to strictly personal use. Furthermore, the buyer declares that they have full legal capacity, enabling them to commit to these general terms of sale.

Cozy Luminaire reserves the right to modify these terms of sale at any time to comply with new regulations or to improve the use of its site. Therefore, the applicable conditions will be those in force on the date of the order by the buyer.

Article 2. Products

The products offered are those listed on the website https://cozyluminaire.com/ of Cozy Luminaire, within the limits of available stocks. The company reserves the right to modify the assortment of products at any time. Each product is presented on the website in the form of a description outlining its main technical characteristics (capacity, use, composition, etc.). Photographs are as faithful as possible but do not engage the Seller in any way. The sale of products presented on the site https://cozyluminaire.com/ is intended for all buyers residing in countries that fully allow the entry of these products into their territory.

Article 3. Prices

The prices listed on the product sheets in the online catalog are in Euros (€) including all taxes (VAT) applicable on the day of the order. Any change in the VAT rate may be reflected in the price of the products. Cozy Luminaire reserves the right to change its prices at any time, provided that the price listed in the catalog on the day of the order will be the only one applicable to the buyer. The prices indicated do not include delivery charges, which are invoiced in addition to the price of the products purchased based on the total amount of the order.

Article 4. Ordering and Payment Terms

Secure payment via PayPal or credit card (via the PAYPAL system): the buyer selects the products they wish to order in the "cart," modifies if necessary (quantities, references, etc.), verifies the delivery address or enters a new one. Then, shipping costs are calculated and submitted to the buyer, along with the name of the carrier. Next, the buyer chooses their preferred payment method: "Payment by PayPal." The next step allows them to verify all information, review and accept these general terms of sale by checking the corresponding box, then prompts them to confirm their order by clicking the "Confirm my order" button. Finally, the buyer is redirected to the secure PAYPAL interface to securely enter their PayPal account details or personal credit card information. If the payment is accepted, the order is recorded, and the contract is definitively formed. Payment by PayPal account or credit card is irrevocable. In case of fraudulent use thereof, the buyer may demand the cancellation of the payment by card; the sums paid will then be credited or refunded. The cardholder's liability is not engaged if the disputed payment has been proven to be fraudulent, remotely, without physical use of their card. To obtain a refund of the fraudulent debit and any bank charges that the operation may have generated, the cardholder must contest the charge in writing with their bank within 70 days of the transaction, or 120 days if the contract with the bank so provides. The amounts withdrawn are refunded by the bank within a maximum period of one month after receipt of the cardholder's written contestation. No fees for refunds will be charged to the cardholder.

Confirmation of an order implies acceptance of these terms of sale, acknowledgment of having perfect knowledge of them, and waiver of the buyer's own conditions of purchase. All data provided and the confirmation recorded will constitute proof of the transaction. If the buyer has an email address and has provided it on their order form, Cozy Luminaire will communicate the confirmation of the order registration by email.

Article 5. Shipping and Return Policy

The choice of carrier is made based on the destination of the shipment. We offer free delivery for all orders. Packages are usually shipped within 48 hours of the order. Your purchases may be sent in multiple packages due to the size of certain products. You will be able to track each package by tracking number. We guarantee consumer satisfaction. If you are not satisfied with your purchase, an exchange for an item of equal value or a refund is allowed. The return of the item(s) is at the customer's expense. We accept exchanges or refunds within 14 days of receipt of the items. The item must be returned in its original condition. Any damaged product will not be exchanged or refunded.

Article 6. Reservation of Ownership

Cozy Luminaire retains full ownership of the products sold until full payment of the price, including principal, fees, and taxes.

Article 7. Right of Withdrawal

Under Article L121-20 of the Consumer Code, the buyer has a period of fourteen working days from the delivery of their order to exercise their right of withdrawal and return the product to the seller for exchange or refund without penalty, except for return costs.

Article 8. Delivery

Deliveries are made to the address indicated on the order form, which must be within the agreed geographical area. Delivery times are given as indicative only; if they exceed thirty days from the order, the sales contract may be terminated and the buyer reimbursed. Cozy Luminaire can provide the buyer by email with the tracking number of their package. The buyer is delivered to their home by their carrier. In case of the buyer's absence, they will receive a notice of delivery from their carrier, allowing them to collect the ordered products from the nearest post office within a time period specified by the postal services. The buyer is required to check, in the presence of the post office employee or carrier, the condition of the packaging and its contents upon delivery. In case of damage during transport, any claim must be made to the carrier within three days of delivery.

Article 9. Warranty

All products supplied by Cozy Luminaire benefit from the legal guarantee provided by Articles 1641 et seq. of the Civil Code. In case of non-conformity of a product sold, it may be returned to Cozy Luminaire, which will take it back, exchange it, or refund it.

Article 10. Liability

Cozy Luminaire, in the process of distance selling, is only bound by an obligation of means. Its liability cannot be held liable for damages resulting from the use of the Internet network, such as data loss, intrusion, viruses, service disruption, or other involuntary problems.

Article 11. Intellectual Property

All elements of the website https://cozyluminaire.com are and remain the intellectual and exclusive property of Cozy Luminaire. No one is authorized to reproduce, exploit, or use any elements of the site, whether in the form of a photo, logo, visual, or text, in any way, even partially.

Article 12. Personal Data

Cozy Luminaire undertakes to preserve the confidentiality of the information provided by the buyer, which they may transmit for the use of certain services. Any information concerning them is subject to the provisions of Law No. 78-17 of January 6, 1978.
